As Esa Moda Giyim Sanayi ve Dış Ticaret Limited Şirketi, we would like to inform our valued customers, within the scope of the regulations introduced by the Law on the Protection of Personal Data No. 6698, about how your personal data is collected, processed, and for what purposes it is processed, in our capacity as the “Data Controller” as defined under the Law.
Your personal data obtained by our company is processed by us, as the data controller, within the scope explained below in accordance with the Law on the Protection of Personal Data. We store your personal data with due care by taking all necessary technical and administrative measures to ensure an appropriate level of security.
The personal data that you, our valued customers, share with our company either by giving explicit consent or without requiring explicit consent as permitted by law may be lawfully recorded in company records, processed in accordance with the Law on the Protection of Personal Data, transferred to persons located in Turkey who are connected with our company limited to our fields of activity and service, stored, used for profiling, and classified.
Among your personal data, identity information such as name, surname, Turkish Republic identity number and signature; contact information such as address, telephone number and email address; and other data may be processed for the purposes of establishing, performing and supervising business and other contractual relationships. In addition, only for employees, blood group information, camera recordings for security purposes, data related to occupational health and safety, financial information, monitoring of payments, and data necessary for the performance of contractual relationships may be processed within the framework of our legal obligations and legitimate interests, provided that your fundamental rights are not harmed.
Your processed personal data may be subject to operations such as recording in written or magnetic archives, storing, retaining, preserving, processing, obtaining, making available, using, updating, modifying, combining, reorganizing, classifying, disclosing, sharing, transferring, transmitting and other operations stipulated under personal data legislation, in accordance with the purpose of processing and for the period required.
Method of Collection, Legal Basis and Purpose of Processing Personal Data
Your personal data may be collected within the scope of the Law No. 6698 in order to provide the relevant products and services within the specified legal framework and to fulfill our company’s contractual and legal responsibilities completely and accurately.
Your personal data may be collected through all kinds of verbal, written or electronic means during the establishment and performance of contractual relationships, as long as you benefit from our products and services, when you visit our company, branches, stores or call center, and through general directorate units, social media, mobile applications or similar applications, our website, online transactions, seller and/or dealer network and other distribution channels.
Your personal data may also be collected by our customers, business partners, persons directly or indirectly connected with us, various official institutions, our direct or indirect affiliates, subsidiaries, controlling shareholders, and real or legal third parties from whom we receive or provide services, automatically or manually.
The processed personal data is processed based on legal grounds such as obligations arising from laws, the explicit consent of the person, obligations arising from the establishment of a contract, the legitimate interests of the data controller, and the fulfillment of the legal obligations of the data controller.
Your personal data is processed for purposes including carrying out the commercial activities conducted by our company; performing the necessary activities to enable you to benefit from the products and services offered by our company; carrying out related business processes; determining and implementing our company’s commercial and business strategies; customizing and recommending the products and services offered by our company according to the tastes, usage habits and needs of the relevant persons; carrying out membership, sales, advertising, communication, promotion, marketing and store card transactions and related notifications and applications.
Your personal data may also be processed for planning and carrying out special sales and marketing activities for our customers; conducting and executing customer services and relationships; ensuring the legal and commercial security of our company, persons in business relations with our company, and third parties; conducting administrative operations for communication carried out by our company; ensuring the physical security and supervision of our company locations; managing customer evaluation, complaint management, reputation research, event management, legal compliance, audit, financial affairs and similar processes.
In addition, your personal data may be processed for establishing, exercising and protecting rights arising from private law and legislation; fulfilling after-sales support service obligations; customer satisfaction; corporate communication activities; planning and execution of customer relations and customer request and complaint management processes; ensuring that company activities are carried out in accordance with company procedures and relevant legislation; planning and execution of business continuity activities; corporate sustainability; corporate governance; strategic planning; information security processes; planning, auditing and execution of relationships and activities with business partners, other companies, dealers or suppliers.
Retention Periods, Sharing of Personal Data and Your Rights
Your personal data processed in accordance with legislation and law will be deleted, destroyed or anonymized by our company when the purpose requiring its processing no longer exists and/or when all periods, including limitation periods required by the relevant legislation, expire.
Your personal data may be shared domestically with public institutions and organizations authorized to request such data by law, our legal unit, business partners, subcontractors and performance assistants, provided that sufficient and effective measures are taken in accordance with the security and confidentiality principles specified under the legislation, and only for the purpose of providing the services we offer.
You may give explicit consent/approval by filling out the forms physically available at our company. You may withdraw the consent/approval you have given at any time physically or request its deletion by filling out the KVKK Application Form available on our website.
We would like to remind you, our valued customers, of your rights as data subjects under Article 11 of the Law No. 6698. Accordingly, you have the right to:
In order to exercise the above-mentioned rights, you may submit your request by filling out the KVKK Application Form, provided that you verify your identity, and send it to us through the methods determined by the Personal Data Protection Authority, by email to sefa.uzun@esatekstil.com.tr, by sending it to the postal address stated below, through a notary public, or by personally visiting our company.
Your request will be answered within the legal period.
